Terms and conditions
The general conditions of sale that apply to the contractual relationship between Detic.it and the Customer are those published on the Site at the time the order is placed.
The order implies acceptance of these general conditions of sale. The Parties agree that the contract is governed by Italian law.
The Customer may request information, send communications by contacting Detic.it customer service at the email address ordini@detic.it or at the postal address of Detic.it – Via Cosenza 21/23 75100 Matera - ITALY.
The sales process through the Site was carried out in full compliance with the legislation on distance selling, electronic commerce, and in particular in compliance with the Italian Consumer Code Legislative Decree n. 206 of 6 September 2005 and subsequent amendments. mod. and int.
The use of the distance selling process described in these general conditions of sale is reserved for consumers (hereinafter "the Customer" or "the Consumers") who act on their behalf and are resident in Italy.
The purchase order through the Site implies knowledge and acceptance of these general conditions of sale.
The products covered by the contractual relationship governed by these general conditions are all the articles published on the Site at the time the order is placed, as specified in the "Products" section.
In the case of promotional offers having a certain duration, the Consumer must pay attention to the time limits of validity of the offer.
Acceptance of the offer
The acceptance and confirmation of the order are carried out by entering data in the following phases:
1. Adding the selected products to the cart
2. Cart validation
3. Indication of personal coordinates
4. Selection of the payment method Up to the stage preceding the "payment", the order can be modified by clicking on the "cart" icon at the top right of the screen.
In case of payment by credit card, the final acceptance by the Customer is made by entering his bank details (credit card number and expiry date).
In case of payment via Paypal or Shopify Payments, the final acceptance by the Customer is made by entering the requested data on the Paypal or Shopify site.
In case of payment by bank transfer, the definitive acceptance by the Customer takes place with the payment and subsequent crediting, to the current account indicated at the time of the order confirmation, of the established amount.
The products and the prices
1. Rates
The selling price of the products online on the Site, indicated in Euros, is the one in force at the time of registration of the order by the Customer.
Prices include the current VAT rate at the time of the order.
The sales prices of the products applied to the contractual relationship with the Customer will be those in force and published on the Site at the time the Customer registers the order.
2. Product characteristics
In accordance with articles 52 and 53 of the consumer code, the company Detic.it provides Consumers with information relating to the Products and, on the Site, informs Consumers of all the main characteristics of the Products offered (dimensions, composition, description , etc.) and the price, including taxes and duties.
The characteristics of the Products will be visible through digital or photostatic reproduction published on the Site illustrating the offer as faithfully as possible.
The image is not part of the contractual relationship between the parties. The craftsmanship (handmade) makes the product always unique and exclusive; moreover, modifications due to the reproduction of the image may be revealed, therefore the Consumer acknowledges that the photograph of the Product present on the Site has an indicative value.
All information is given through the Site in accordance with article 52 of the consumer code.
The order
The order placed by the Customer presupposes acceptance of all the provisions of these general conditions of sale (choose the methods: telematics by ticking the appropriate boxes or by sending back the duly signed general conditions by fax or e-mail, as suggested to end of this text).
Any order placed by the customer through online payment will be taken into consideration by Detic.it only after the payment has been accepted.
Detic.it will send the Customer an order confirmation e-mail which will contain all the details of the order and the information required by law: a summary of the General Conditions of Sale, the pre-contractual information relating to the essential characteristics of the goods purchased , the detailed indication of the price, the means of payment used, the payment instrument chosen, the delivery costs, the delivery terms, as well as information and instructions on the right of withdrawal and related costs, and legal guarantees.
The sale will be considered definitive after this confirmation has been sent to the customer, as well as the availability of the product and the payment of the relative price by the customer.
The contractual reference date, for the purposes of guarantee, withdrawal, etc., will be that of sending the confirmation and acceptance of the order.
To modify the order, the Customer can click on the "Your cart" icon at the top right of the screen.
Modification is always possible up to the stage before payment.
The Customer can cancel the order through his right of withdrawal according to the methods defined in the Withdrawal section; the order cancellation request can be taken into account by sending an e-mail to ordini@detic.it
(better to use a certified mail, or write: by sending by registered letter with return receipt to the registered office indicated above).
The order, once confirmed, CANNOT BE MODIFIED ONLINE either as regards the items or as regards the delivery address, without prejudice in any case to the Customer's right of withdrawal.
The order which, after various delivery attempts by the delivery carrier, returns to the sender, cannot be returned. If the order has been paid, it will be refunded net of a penalty equal to the costs incurred for the shipment (minimum € 50.00) and the material used and not sold, quantified at a flat rate of 20% of the order amount.
If the Customer wishes to change the delivery date of the package, he must contact the courier directly when the package is being delivered.
The Customer must keep the information contained in the order confirmation sent by Detic.it on a paper or electronic document.
Detic.it sells the products on its Internet site only to retail and final consumers.
Any order that manifestly does not correspond to a retail sale and, more generally, any fraudulent order or as presumed to be such, will be considered null and void by Detic.it and prosecuted in the appropriate judicial offices.
Confirmation and archiving of the order
The order form will be filed in the Detic.it database for the time necessary to execute it and, in any case, in accordance with the law.
The order confirmation will contain the conditions, terms and modalities of the right of withdrawal completed with the retraction form.
To access your order form, the Customer must access "Your Account" "Order Status".
The summary of the instructions relating to access to the order form will in any case be present in each order confirmation e-mail.
In the case of an invoice request, the Customer must request it at the same time as the order, by sending an e-mail to the address: ordini@detic.it
Dispute regulation
In the event of a dispute arising from this contractual relationship, the parties undertake to seek, before any legal action, a solution dictated by common sense.
The parties agree that all disputes relating to sales through the website as described above will be referred to the jurisdiction of the Matera court.
The applicable law is the Italian law. Although not specified, reference is made to the regulations on consumption, in force at the time of the order.
IT IS RECOMMENDED TO SEND A COPY OF THE GENERAL CONDITIONS AND REQUEST THEIR RETURN WITH SIGNATURE IN EACH PARAGRAPH FOR READING, KNOWLEDGE AND ACCEPTANCE, OR SIGN AT THE END, but with reference to the vexatious clauses (indicate all the paragraphs, suitably numbered and with a summary of their content: e.g. order, withdrawal, etc…).
